Subscription terms

This document is a public offer by KAKADU SECURE TECHNOLOGIES - FZCO (hereinafter the "Company", "we") to provide access to the paid "Plus" subscription in the Kakadu AI application (hereinafter the "Service"). By paying for the subscription, the User confirms that they have read and agree to these terms as in effect at the time of payment.

2. Subject of the Agreement

Kakadu AI is an application with an AI assistant and file storage. Available on iPhone/iPad, Android, desktop (Windows, macOS, Linux), and in a browser.

Free access (unlimited in time, for everyone):

• 10 AI requests per day
• 1 GB of storage
• up to 5 devices
• up to 5 people in a family group
• Kids Mode (protection from adult content)

Paid "Plus" subscription, purchased through the App Store or Google Play with automatic renewal:

• a significantly higher daily AI request limit
• storage with no stated limit
• up to 5 people on a single subscription (family)
• up to 5 devices
• Kids Mode (protection from adult content)

3. Price

The subscription price is $29.99 (USD) per month. The exact price and currency are displayed in the App Store or Google Play at the time of purchase; the price may be shown in your local currency, with the currency conversion and final amount determined by the payment platform (Apple or Google), and the Company has no influence over this.

The price is fixed for the User as of the date the subscription is purchased, see Section 10.

4. Automatic Renewal

The subscription renews automatically for a new period (1 month) unless auto-renewal is turned off at least 24 hours before the end of the current period. Payment for the next period is charged within 24 hours before the end of the current period. You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings.

5. Payment Methods

Kakadu AI Plus subscriptions are purchased and paid for through the Apple App Store or Google Play.

The Company has no technical ability to cancel a subscription or issue a refund for purchases made through the Apple App Store or Google Play — these actions are performed exclusively by Apple and Google, respectively.

6. How to Turn Off Auto-Renewal

• Apple App Store: only through Apple ID settings; the User cancels it themselves, and the Company has no access to do this on the User's behalf.
• Google Play: only through Google Play settings; the User cancels it themselves, and the Company has no access to do this on the User's behalf.

7. Family Access

The subscription is purchased by a single User (the "Owner"), who also pays for it. The Owner may invite up to 4 additional people (up to 5 in the group in total), who receive paid access at no extra cost. Family group members cannot manage the subscription and do not make any payments. If the Owner does not renew the subscription, paid access ends simultaneously for all group members.

8. Data After the Subscription Ends

After the paid subscription ends, previously uploaded files are not deleted and remain available for viewing. Only uploading new files beyond the free storage limit (1 GB) is restricted.

9. Age Restrictions

The Service has a content age rating of 16+.

A paid subscription may be purchased by a legally capable individual who has reached 18 years of age. A minor may purchase a subscription only with the consent of their legal representatives (parents, adoptive parents, or guardians).

If a subscription was purchased by a minor independently, without the consent of legal representatives, the legal representative may contact the Company's support to cancel the subscription and request a refund, in accordance with applicable law governing contracts entered into by minors.

10. Price Changes for Existing Subscribers

A User who purchased a subscription at the price in effect at that time continues to pay that price even after the price for new subscribers changes.

If the Company decides to move existing subscribers to a new price, it will notify them at least 30 days before the new price takes effect, via a push notification and an in-app notice.

11. Changes to These Terms

The Company may amend these terms. The new version is published at the same permanent address, indicating the new date and version. Previous versions of the document are archived and remain available; they apply to payments made while they were in effect.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of the United Arab Emirates.

The parties shall seek to resolve any disputes and disagreements arising from this agreement through negotiation. The User may send a complaint in any form to KakaduAi@yandex.ru or through the support chat in the app. The response time for a complaint is 30 days from the date of its receipt.

If a dispute is not resolved through the complaint procedure, it shall be submitted to the competent courts of the United Arab Emirates. Nothing in this Agreement limits any statutory rights the User may have under the mandatory consumer protection laws of their country of residence.
